AI Governance in UK Law Firms: Why Compliance Officers Need Better Support in 2026

AI governance is a resourcing problem, not a compliance failure. 93% of mid-size UK firms use AI. The people responsible for governing that use are stretched thinner than ever.

In the past eighteen months, AI tools in UK legal practice have gone from experimental curiosity to daily infrastructure. According to recent industry data, 93% of mid-size UK law firms now use AI in at least one workflow. Harvey's 2026 survey found that 80% of lawyers use AI at least weekly, and 40% use it multiple times a day.

That speed of adoption has created a problem that nobody seems to want to talk about.

The people responsible for governing all of this new technology, from compliance officers to COLPs to risk managers, were already carrying enormous workloads before AI arrived. Now they're being asked to oversee an entirely new category of risk, often without additional resources, training, or tooling to help them do it.

This is not a story about compliance officers falling short. The industry moved faster than the support structures around it, and the people on the front line of governance are feeling it.

The real governance gap is bandwidth, not knowledge

The SRA published findings from its December 2025 thematic review of compliance officers, visiting 25 firms and interviewing 36 individuals. The results painted a picture that anyone working in compliance will recognise: these professionals are managing an increasingly complex regulatory landscape with the same resources they had five years ago.

At most mid-size firms, the COLP is not just the compliance officer. They're often a practicing solicitor who handles regulatory obligations alongside a full caseload. They sit on management committees. They deal with complaints, risk registers, SRA reporting, AML compliance, data protection, and professional indemnity renewals. AI governance landed on top of all of that, and nothing was taken off the pile.

That is a significant responsibility, and it's being asked of professionals who, in many cases, have had no formal training on AI governance, no dedicated budget for it, and no tools designed for the way they actually work.

Compliance officers understand the importance of AI governance. The question is whether anyone is giving them what they need to do it well.

AI is new for everyone

Generative AI in legal practice is still new. It only moved into widespread adoption across UK mid-size firms in 2024, and accelerated through 2025. The regulatory frameworks are still catching up. The SRA is currently preparing a GenAI FAQ document and a Good Practice Note on AI use and client data, neither of which has been published yet. They held a webinar on AI Policy and Regulation in February 2026, which signals that even the regulator is working through this in real time.

When the regulator is still developing its guidance, it is unreasonable to expect every compliance officer to have a complete governance framework already in place. What matters is the direction of travel: that firms are taking this seriously and building towards something robust.

The three areas the SRA is watching

Full guidance is still forthcoming, but the SRA has been clear about the risk areas it considers most pressing when law firms adopt AI tools.

Confidentiality and data handling. When lawyers use AI tools, where does the data go? Is client information being processed offshore? Could it end up in training datasets? The answers vary significantly by vendor. Some offer on-premise deployment and UK-based data centres. Others operate entirely in the cloud with less transparency about data flows. Getting clarity on these questions currently requires navigating complex vendor terms that were not written with COLPs in mind.

Competence and output verification. AI-generated legal research and drafting can contain errors, including confident-sounding errors that are hard to catch without careful review. The SRA expects that firms using AI tools have clear protocols for human verification of AI outputs. This is about maintaining the standard of care that clients deserve.

Supervision, especially for junior lawyers. Junior lawyers and trainees are often the heaviest AI users, which is understandable given that these tools are natural productivity amplifiers for people earlier in their careers. But it creates a supervision question: who ensures that a trainee's AI-assisted work product meets the same standard as traditionally produced work? Supervision frameworks need to evolve, and compliance officers need practical guidance on what that looks like in practice.

What a right-sized governance framework looks like

One of the problems with the current conversation around AI governance is that most frameworks are designed for large enterprises or magic circle firms with dedicated innovation teams and six-figure technology budgets. That is not the reality for most UK mid-size firms.

A governance framework does not need to be a 60-page policy document. For a firm of 50 to 200 people, it needs to be practical, maintainable, and proportionate to the actual risk. Based on what the SRA is signalling and what compliance professionals are telling us they need, a workable framework covers five areas:

AI Register.

A simple record of which AI tools the firm uses, who uses them, what data they process, and where that data goes. This is the foundation. You cannot govern what you have not mapped.

2.
Acceptable Use Policy.

Clear guidance on what types of work AI can and cannot be used for, what client data can be input into which tools, and what disclosure obligations exist. Written in language lawyers actually read, not a template downloaded from the internet.

3.
Output Verification Protocol.

A defined process for reviewing AI-generated work before it reaches a client. This does not need to be a bureaucratic bottleneck. It needs to be a habit. Who reviews what, at what stage, and what gets documented.

4.
Training Requirements.

Not a one-off webinar, but an ongoing programme that ensures everyone using AI tools understands the capabilities and the limitations. Compliance officers need training too, on the technology itself and on the regulatory expectations around it.

5.
Incident Response Plan.

What happens when something goes wrong? If an AI tool produces an incorrect legal analysis that reaches a client, or if a data handling breach occurs, who does what? Having this documented before you need it is the difference between a managed incident and a crisis.

None of this requires a dedicated AI team. It requires a compliance officer with the right support, the right tools, and the time to do it properly.

The August 2026 deadline adds urgency

The EU AI Act enters enforcement in August 2026, four months from now. While it is European legislation, its extraterritorial reach means any UK firm advising clients with EU operations, contracts, or customers will need to understand its requirements. This sits alongside the SRA's own evolving expectations and the broader industry shift toward formalised AI policies. Gartner projects that more than 80% of enterprises will have deployed GenAI-enabled applications by 2026, yet for most, formalised governance still lags well behind adoption.

For compliance officers already stretched thin, this creates real and immediate pressure. The firms that act now, even with an imperfect first framework, will be in a far stronger position than those that wait for perfect guidance that may not arrive before the deadlines do.

Support, not blame

A question for firm leadership

If your firm is among the 93% using AI, ask yourself: has your COLP been given dedicated time, a budget, and the right tools to build an AI governance framework? Or has AI governance been added to an already-full plate with the implicit expectation that they'll figure it out?

If it is the latter, the gap is not in your compliance officer's knowledge or commitment. It is in the support they have been given.

Closing that gap before the SRA's next thematic review, before the EU AI Act enforcement date, before an incident forces the conversation, is one of the highest-value investments a firm can make right now.
